Posted - 08/03/2018 : 1:43:15 PM This is just the initial ramblings of how I would like to see the laws work. I’m sure there are other factors that come into play but let’s just have fun with this. If you read a lot of the other forum topics, there is a lot of sneaking around trying not to get caught taking out the trash or getting the mail...that kind of thing. Some that have been caught by a neighbor found them understanding or at least they didn’t care enough to file a complaint with the police. My dream would be a law where there was no harsh punishment for casual nudity. For example, you go out in front of your house at noon to get the mail and go back in the house. Neighbor sees you and files a complaint...maybe they have young kids...whatever. You get a call or visit by the police to tell you a complaint has been filed and to not get your mail during the day unless you are clothed. Thank you...have a nice day. If no one complains...you’re golden. If you persist and continue to get your mail during daylight hours...you get a warning and maybe even a small fine on your second complaint. Do it again (3rd strike) and you get whatever the law currently is for your state. This would allow us a little more freedom to live life as we all like on this forum...naked. This law would apply initially to your own home and property...going to the grocery store or beach would evolve slowly as more people become more accepting of casual nudity. We would no longer be hiding behind shades in our own homes or sneaking around at night in our own yard if you live in an area where no one complains. Obviously, if a complaint is filed, we would comply...although probably not until after you get the second strike. That’s the way I would play it. Who knows...you might go out to get the mail every day and not get the second strike until a month later or even longer or never. Wouldn’t that be a great way to live? Like I said...it’s just a dream...but who knows. |

Posted - 08/23/2018 : 6:01:35 PM As nudists / naturists most of us find the wording of these laws offensive and not the human body as we are all comfortable seeing others and being seen at CO beaches or resorts or where ever. The wording is abhorrent to us as we don't see the body as offensive. The wording of many of these laws seems to reflect very strict religious views or interpretations from a time gone by (reckless, frightening, insulting, etc).
I have no issue with people masturbating in public in front of people being taken to task or even purposely walking around in public with an erection (proving intent may be interesting, but if you get an erection, cover up and wait a while). Casual nudity that many / most of us enjoy is not anything like that and I would like to see exempt. However we live in strange times where people can post almost whatever they like online in the form of sex and there being nothing done about it but one of us in our private / fenced yards could have an action taken against us. Makes no sense. |

Posted - 08/23/2018 : 1:59:18 PM My “unofficial “ opinion would be that you should be OK because even though you are knowingly exposing genitalia, it is not in the presence of another person and you are not openly visible to the public or have taken precautions for not being seen, it shouldn’t be considered reckless. Again...just my interpretation. But is one out of three enough for them to convict? That’s where it is open to interpretation. |

Posted - 08/23/2018 : 12:54:58 PM I would like to see what everyone's thoughts are on the wording to this Statute from Alaska. It states in part; 'An offender commits the crime of indecent exposure in the second degree if the offender knowingly exposes the offender's genitals in the presence of another person with reckless disregard for the offensive, insulting or frightening effect the act may have'. My take is that if one is in their own yard, doing yard work, washing vehicles or just doing things in the yard and can not be readily seen from a public road, then there was no 'intent' to be offensive. Thoughts! |

Posted - 08/18/2018 : 12:11:18 PM Well I don't know if I would call it sneaking around, maybe in some cases, or maybe wanting to be seen naked especially if it's never happened to you before(very exhilarating experience). Your example of the neighbors with young kids seeing you naked filing a complaint, as the nudist though nothing would have to be filed but I would have a complaint against them for not living and raising their kids in the nudist lifestyle when it's so much fun! As far as checking the mail and taking out trash in the nude I've taken out the trash nude usually at about 1 am when no one was awake, never gotten the mail in the nude but have gotten the newspaper in the nude just once though at about 7 am so yes a more risky time of day and taking out the trash nude was years ago. So I went nude in the backyard where I thought no one would see me anyway with there being a wall, but some neighbors let me know but writing "send nudes" on the windows of my car, so they must like seeing me nude so no complaints only complements and I have to assume it was the neighbors in the second story corner house and now that the storm knocked down a big tree in the front yard the neighbors next to them will get to see me nude now too, if the tree had been blocking their view beforehand. I also noticed a few weeks ago that neighbors behind me 2 houses over have a security camera, it looks like panned just to view their backyard but it's possible I could've been seen on there since it's at a high enough position and the neighbors directly behind me put a trampoline like thing in their backyard for their kid, so if I'm nude in the backyard and the kid is jumping on the trampoline I could be seen, there's always the possibility that could happen, hasn't happened yet though. As far as nudity being accepted in more public areas like the grocery store that of course would be ideal but would it but compared to women breastfeeding in public, as a saw a few months ago in a restaurant I was at, everyone there seemed fine with it and she wasn't asked to leave or anything and she covered herself while doing it, but even if she hadn't, why hide such a natural process. Oh Nude in AK I thought you were talking about statues for a second, there's a certain part of town I haven't been to in awhile, but I think there are statues of nude children downtown but no one complains about those because they're inanimate objects and are art pieces. Let's hope nudity gets excepted in more neighborhoods and public places, that the laws become more lenient over time and to keep the dream alive and keep fighting for it.

Posted - 08/15/2018 : 5:28:30 PM Very true! I can see where walking out to your mailbox in broad daylight would be “reckless” but in your backyard, with precautions for not being seen of course, should not. But again, how would it be interpreted by local entities? Both could be treated the same. |

In one they talk about 'reckless disregard for the offensive, insulting or frightening effect the act may have' (being nude). What does one being in their back yard or place that can not be easily seen from a public road mean? It would seem that we are in our own area and not trying to impose on others. As has already been said, 'we can only hope'! |

Talks about exposing the genitals, intentional exposure of the genitals, the exposure being sexual and the exposure being in a public place. In walking out the front of my house I'm not sure I agree its a public place as my land is private property but can be seen from a public place, (the road) as we have no fence. And while you can see my genitals, it was not a sexual act or sexual in nature so I'm not sure that is applicable. If the paper is on the grass in front of the land boundary I would be in a public place. However is simply being naked "sexual in nature" or is any exposure sexual?
Yes this is a crazy law. Simply being naked is not sexual, walking around with an erection probably would be or fluffing to achieve one would be ( I think) but simply being naked is not sexual, guess it reflects the hang up our societies have in this context. Going to a CO beach and lying in the sun or walking on the beach is not sexual in nature. The people who go there to try to pick up and have sex in the sand dunes are acting in a sexual way, there seems a clear difference.

I usually look first just in case someone is out there, I'm not trying to cause a problem, I'm just avoiding getting dressed for such a simple and quick task. Bill, you've made me look at the indecent exposure laws here in Victoria, plus the others you mention along the same lines. Might have to push for a law change here too, but I won't hold my breath. |

Be cooperative and you may just get a warning, but act like an idiot and the outcome would probably be much different. |

Posted - 08/11/2018 : 3:30:49 PM I’m not a lawyer, and my advice is worth only what you pay for it, but I have studied the indecent exposure laws in all 50 states. Generally speaking simple public nudity is not a violation in almost all states. There must be an element of lewdness or sexual activity for one to be quilty of indecent exposure. Of course it is possible to be cited for disorderly conduct or disturbing the peace in stead, but I believe one could argue their way out of that if the police officer is reasonable. I think that simple public nudity is an issue the police and the courts would prefer not to deal with, so if you’re cooperative I believe you can avoid legal difficulties.
I once returned from my vacation a day early and failed to notify the local police, who had been watching my home while I was gone. While I was soaking nude in my hot tub a policeman came around the back of the house and asked me to identify myself. He didn’t say anything about what I was wearing.
