The depiction of adults and children nude in the visual media has enjoyed constitutional protection in the United States since 1958, when the Supreme Court vacated a Court of Appeals finding that Sunshine & Health magazine could be obscene (Sunshine Book Co. v. Summerfield, Postmaster General, 355 U.S. 372). The right to depict adults and children in innocent nude poses has been upheld without a pause for 41 years. In case after case, the Supreme Court and lower courts have always upheld the constitutionality of "nudity without more," specifically referring to the nudist depiction as a fully constitutional form of expression. Posted - 08/27/2011 : 10:45:43 PM there was a wealthy man in west palm beach florida years ago that owned a good bit of beach area and allowed others to use it as a nude beach too, unfortunately he passed away and it was deeded to the state so you guessed it no more nude beach but a small group of the originals continued and yes were arrested and somehow found a loophole in the law and if they made it a artistic - play it was somehow legal, needless they had a play and somehow the sheriff didn't get the memo and arrest were made. somehow they got a new memo from the court and a new nude play occurred and no arrest but it didn't change anything and it was only a matter of time when miami woke up and haulover beach was formed. i think if public nudity was more acceptable there would be very little sex crimes and the dark hidden body would be more acceptable. |

Wow, I had seen the link to Illinois voting, but didn't notice the little link to the "dating site" until you brought it to my attention. Perhaps that dating link could be removed?
The voting campaign, on the other hand, is "mah-velous, simply mah-velous"; I love that it is not touting nudity itself, but using the nude actors to promote voting rights. Better even than the "where's the beef" ads of twenty years back, I think, in its subliminal action. That sort of approach, which makes the assumption that we all spend some time at home in the buff, so you might as well be voting thus, is a great attitude to promote. The fact that it also promotes participation in democracy is a nice aside, too.

In 1958 Supreme court of USA holds S+N and Sun nudist magazines worthy of First Amendment right,free assocation, not obscene and worthy of postal privileges, depicting wholesome, family social nudism not lewd or lascivious in nature.Child protection laws in place to protect them against exploitation,abuse and porn are very risky and could be criminal to those depicting the images of minors in any format/forum, they have rights too.

Posted - 09/25/2010 : 03:39:23 AM I wish nudism were covered by the First Amendment, but alas, it is not. However, the Constituion touches upon our natural rights to make contracts, and from that, we can be nude in places where we have made a contract, of sorts.
States, counties, and cities, cannot interfere with our right to contract, unless we contract to commit crimes. Nudity, in public, is not a private contract, but it can be a governmental contract between the state and the people in places like beaches. It's not a compulsive contract, but it does allow nudity in some places.
Just speaking for myself, nudity is not a form of expression in the nudist world. It's a passive form of being, in which we can gather together in private or some public places to feel the luxury of not having on any clothes. I don't believe that I project nudity, but simply feel it for myself. True, hypothetically some people would think my nudity was an expression with a strong social message. That is their choice of thinking, but not mine. Their objections would be an expression of digust at the nude human body in other than the bedroom or bathroom. Of course, we all disagree with that opinion!
Circumstances of "expressing" nudity would be in cases of exhibitionism, strip dancers, and the like.
