The "expectation of privacy," as a legal concept with a precise definition, is found only in U.S. case law. It is related to, but is not the same thing as a right of privacy, a much broader concept which is found in many legal systems (see privacy law).
There are two types of expectations of privacy:
* A subjective expectation of privacy is an opinion of a person that a certain place or situation is private. These obviously vary greatly from person to person. * An objective, legitimate or reasonable expectation of privacy is an expectation of privacy generally recognized by society.
Examples of places where a person has a reasonable expectation of privacy are person's residence and public places which have been specifically provided by businesses or the public sector to ensure privacy, such as public restrooms, private portions of jailhouses,[1] or a phone booth.[2][3]
In general, one cannot have an expectation of privacy in public places, with the exceptions mentioned above. A well-known example is denial of privacy for garbage left for collection in a public place.[1]
While a person may have a subjective expectation of privacy in his car, it is not always an objective one, unlike a person's home.[4]
The privacy laws of the United States include the notion of a person's "open fields"; that is, places where a person's possessions do not have an objective expectation of privacy.[5]

Posted - 12/25/2009 : 03:23:56 AM In most states and correct me if I'm wrong because it is the rule here in Kentucky. For private places such as someones backyard surrounded by a fence or a place where a reasonable person would assume they had privacy you're allowed to be nude.
I do believe I remember reading a court case where a man was either 1. sued or 2. arrested for being nude in his backyard. Because he lived next to an airport and the aircraft coming in could see him and his family nude in the backyard. It was eventually assumed that as long as a reasonable person felt they had privacy, then they were conducting the activity in private and not in public and therefore couldn't be in trouble. I could have swore I heard about that case... Maybe I dreamed it... wow I'm gonna make a bad lawyer... research... research... research...

Posted - 12/23/2009 : 3:54:56 PM It seems that there are times when you have to compromise. I like to be nude in my home when it is warm outside, but I keep my publicly oriented curtains and/or blinds closed for obvious reasons. I keep the blinds open in the back of my house because no one can see in, unless they are trespassing and are staring through my windows.
Just use common sense and be caring toward your neighbors. There is a time and place for most things. Remember that textile folks outnumber us, and thus they get their way in matters such as these. You and I might like to be nude no matter what and where, but we don't live in a vacuum.
Imagine if a horde of clothed people invaded a nudist resort or a nudist beach. We might not like that, just as in the "regular world," they might not like nudity. It's a matter of courtesy.

Way to go Mom, teach your child while he is young to be ashamed and embarrassed of the naked body!

Posted - 12/23/2009 : 12:56:27 AM Have to agree with the judge here as well, you cannot in a public setting stand in front of your window nude in front of others. If this judge would have came to the decision that because he was in his home he couldn't be arrested, then you'd have the disgusting people jerking it while little kids when by and it would be legal...
We must understand that while we love to be nude we must respect other peoples privacy... If this man wanted to walk around in front of his window nude he needs to move to a nudist community so that he can do such acts.

Posted - 12/22/2009 : 11:24:39 PM I just ran across this news story from New Zealand. It seems like a better approach for dealing with casual nudism to me.
According to Fox News:
Police picked up two naked men on a late night bike ride in a New Zealand town but let them off with a warning: put on helmets.
"They were wanting to experience total freedom," said Senior Constable Cathy Duder, who stopped the pair about 10 p.m. on a recent night in the beach resort town of Whangamata. She told them: "You may experience total confinement. You should head home and get helmets."
The duo turned tail and headed directly back to their house, Duder told The Associated Press on Wednesday. She said she did not see them again during her shift, and it was not known if they donned helmets and resumed their ride.
Public nudity can attract a charge of offensive behavior in New Zealand, but Duder said she cut the two men a break.
"It was dark and there was no one else around. They were jovial young men who had not intended to cause offense," she said.
She described the two as "happy young men in their mid-20s ... they appeared to be as sober as two judges."
The Dec. 7 encounter, which has only just come to light, probably signaled the start of what Duder described as summer hijinks in Whangamata, a popular surfing and holiday getaway where partying is common during Christmas and New Year season.

Posted - 12/20/2009 : 10:27:12 AM Well, I think Eric Williamson is a great guy, or a fool or maybe both. He called Fox News after his arrest and has argued from the beginning that he should have the right to walk around nude. It is the basic "Nude isn't lewd" issue. He didn't go to jail but,now has a criminal record. This could cause headaches regarding his daughter. I wish him well on his appeal.

We can not jump to the defense of naked people just because they are naked. The facts have not been shared on here but it states that he was trying to be seen as opposed to being viewed without intent of being seen/viewed. |

Posted - 12/18/2009 : 10:07:16 PM I agree with the judge,the man is convicted of intent to flat expose himself,an that is the real BS,it appears that this is not a case of nude living in a private residence ,but standing in the window moves this into the public space not private,its the same if he was standing on the path waitin for her to come by.He recieved a lite punnishment for being stupid,intentional or not ,he is advised to forgetit an move on. |
