I read this morning that a Fort Collins judge has issued an injunction against citing women for being topless in public. He felt that the injunction would hold up at trail and that the laws against women being topless in public were probably unconstitutional.

Hoping more and more judges see fit to not prosecute women for being topless and stop all discriminating laws against women ... but I don't see women suddenly or frequently going topless. It would be a great start for them to at least feel comfortable doing it at a beach, lake or river without being afraid of being arrested or cited.

At our once nude tolerant beach, San Onofre Trail 6, the rangers began citing nudists a few years ago. Luckily, the president of our beach group is a lawyer and convinced the cited nudists to fight the citation and demand a trial. The judge began to throw out the citations because of the history of the beach and the questionable actions of this one particular ranger. After the first few cases were thrown out, the prosecutor refused to take any action toward the nudists for being nude but it did not and has not stopped this ranger from continually harassing any of those that are nude on this beach. So ... many of them have just traveled south to Black's Beach near downtown San Diego.
It would appear that NYC cops have finally gotten the message and have stopped harassing topless women in parks and at the beach. Many places such as NYC, Portland, OR and other progressive cities, have adopted this topfreedom approach toward women but not all women are embracing this new freedom with bare breasts.

Yes, those authorities who hassle topless women are over the top. Glad to see Ft. Collins come to their senses. I'm sure you won't see a rash of topless women, but perhaps a few, now and then, to start with.
Persistence, effort, and patience, make the difference.

FireProf writes, "[B]ut I don't see women suddenly or frequently going topless. It would be a great start for them to at least feel comfortable doing it at a beach, lake or river without being afraid of being arrested or cited."
While I applaud this example of judicial restraint, I would suggest that women's reluctance stems less from fear of arrest than the fear of being leered at, harassed, or photographed without consent. We need to police our few remaining C/O venues better than the police have done.

I agree ...
But I've found with any law enforcement agency ... they are usually looking for the simplest and easiest way out of enforcement of these less criminal offenses. "Just ticket them all and be done with it, or make them wear clothes!"
With regards to San Onofre; we used to call the rangers for help with voyeurs, gawkers, overt sexual activity but the head rangers comments were always, "well, if you put some clothes on, maybe they won't do those things." San O nudists were lucky that the subordinate rangers were quite a bit more accepting.
Policing ourselves is easier said than done though. There truly aren't a lot of us that are willing to stand up and say something to others that are acting inappropriately and tell them that their activity is jeopardizing our ability to continue use of these venues. Easily done at a club or resort, much more difficult in public areas.
But I still agree with you Doc!
