Hi, I hope you can help me...

I am an art/figure nude photographers model based in the UK. I'm currently researching a project, in conjunction with my photographer, of nude studies on location. Our problem is that we can't find much relating to the legalities in the UK of public nudity for photographic purposes.

We don't really want to go to a designated nudist/naturist area, as while I will be nude, the photographer won't be, and an obvious camera and related equipment might be off-putting/offensive to other users of that area.

Can anyone advise me of the best way to go about this project without 1) breaking any laws, or 2) offending any nudists/naturists in the area?

We are very serious about this project and photography, I have added a couple of examples of studio shots that we would like to recreate on location to give you an idea of what we are about...

Thanks for all replies

Jacqui

Sorry, I do not know much about the laws in the UK but you have very nice art. I hope you are able to continue it. Good luck.

You might consider contacting a Barrister or his office about this or contacting the instructors of any figure study classes at local universities.

Thank you for your replies.

Andy, thank you for your kind words. I have every intention of continuing. I love working art nude, the human body is a wonderful and beautiful thing, and I will find a way to do this :)

Teva, thank you for your input. I had considered consulting a lawyer on this, but I hadn't thought about contacting Universities that conduct figure study classes, so I will definitely look into this :)

There are a number of websites run by photographers, some of which specialize in nude pictures. Why not look them up and see what they have to say on the question.
I would like to explore the U.K., but am unlikely to be able to at this point. I. mysdelf, have never been to Britain or any part of Europe, but have some long-ago Asian travel. including a year in Viet Nam.

Thank you for your reply balataf... I am already a member of many photography forums, and the general consensus among the photographers and models is that no-one seems to know for certain... many of the photographers operate on a "shoot and run" basis... harried photographer and model makes for rushed images in my opinion, so we want to be able to take our time to get the very best out of the shoot... I think my best course of action will be to consult a lawyer on the subject... if I find a definitive answer, I will let you all know :)

Hi Jaqui,

From what I have read I believe that per se it is not illegal to be naked in the UK, only to flash or expose oneself in a manner likely to cause public disturbance . If a policeman requests that you cover yourself, do it and then discuss with him the legalities of his request (otherwise you could be arrested for disobeying a request by the police). If you want to have photographs taken in Trafalger Square it would be best to get police permission first (weirder things have happened in London ). Apart from that if you are in a quiet place it should not be a problem. There have been a number of 'naked' public walks in various places in the UK, including those of Steve Gough (he was OK until he reached the Scottish border).

Thanks for that Cony... it's such a grey area, isn't it? We weren't planning on somewhere like Trafalgar Square, the idea was to get the nude in natural surroundings, all back to nature, so to speak, but I'll bear your comments in mind :)

I'm not a lawyer but my understanding is that it's infuriatingly vague. If alarm or offense is given it could illegal and a magistrate or court would have to decide if a police officer decides to arrest you. If no-one is alarmed or offended, it's not illegal. The courts have ruled that simple non-sexual nudity is not offensive by itself. The problem is that you can't really predict the reaction of someone who sees you! If you took care to avoid people, e.g in a secluded area, this would be evidence that you did not intend to cause alarm or offense.

I'm a photographer and can assure you it is not illegal to do nude photo shoots anywhere in the UK, even in Trafalgar Square as Kiran demonstrated.
The kind of standard procedure, to avoid any misunderstanding or random "passerby offense", is to alert the local police station about time/place (they sometimes offer an accompanying officer) and then, when shooting, to set up some sort of obvious perimeter or presence (eg. photographer lights, umbrellas, hovering assistants and makeup person, whatever). As long as it all stays "artistic" and doesn't stray toward "sexual", you should have no problem.

I've taken quite a few photographs of my wife naked in public places. Sounds silly but, illegal or not, the secret for us has been to choose a location where there's no one, or at least, not many people about. Even when we've been unexpectedly caught out, we've never had a problem - quite the reverse, just smiles and the nice comments.
