Virginia Bill Limits Parental Rights Regarding The AANR East Youth Leadership Camp

Dear Friends of AANR:
On January 5, 2004, Delegate John Reid pre-filed a bill with the Virginia General Assembly. As drafted it would forbid the state from licensing a hotel, summer camp, or campground that maintains or conducts as any part of its activity a nudist camp for juveniles. (The bill defines these as camps attended by openly nude juveniles not accompanied by their parents or a legal guardian.)
Without question, the bill is targeting the AANR East youth leadership camp held at White Tail Park.
We wanted to take this opportunity to thank the thoughtful members and groups who have copied us on messages about this development. We also wanted to let you know what we are doing and how you can help.
AANR East President, Bob Roche, is already in the process of engaging a top-notch lobbyist who draws on extensive experience representing the hotel industry. This is one example of how your AANR dues are already helping the cause.
As we get direction from the lobbyist, we will be communicating with you further and are prepared with others throughout the naturist and nudist community to stop this bill. In the meantime, further sensationalism from the media will only serve to keep the spotlight brighter on the lawmaker who benefits from the attention.

Virginia Lawmaker Wants Ban On Nudist Camps For Kids
RICHMOND, Va. -- There will be no more bathing suit-optional summer camps in Virginia, if one lawmaker gets his way.
State legislator Jack Reid is authoring a bill to ban nudist summer camps for kids.
The White Tail nudist resort held a week-long session last June, for children 11-18 years old. Under current law, a camp for naked kids is legal in Virginia, as long as lewd activity isn't involved.
White Tail officials insist they had a strict ban on any sexual contact. But Reid said he wants to put an end to kids "running around naked without their parents there."

Dear Naturist,
A member of the Virginia House of Delegates has prefiled a bill that would forbid nude youth camps of the type operated by the American Association for Nude Recreation (AANR). Delegate John S. "Jack" Reid (R-Richmond) is presently the sole patron for House Bill 158.
Reid's measure would deny an operating license to "the owner or lessee of any hotel, summer camp or campground in this Commonwealth that maintains, or conducts as any part of its activities, a nudist camp for juveniles. A 'nudist camp for juveniles' is defined to be a hotel, summer camp or campground that is attended by openly nude juveniles whose parents or legal guardians are not in attendance."
BACKGROUND
This situation is the latest in an ongoing series of repercussions that can be traced to a New York Times newspaper article published this past summer. The article, which featured details of an AANR nude youth camp in Florida, was not an unauthorized exposé. Rather, it has been described by AANR officials as a "tightly managed" public relations effort.
The article ignited a fierce backlash this past summer among conservative pundits and Republican lawmakers, the most notable of whom was Congressman Mark Foley of Florida.
BEYOND FLORIDA
In addition to its focus on the Florida nude youth camp, the New York Times article mentioned similar camps in Virginia and Arizona. It also included an erroneous reference to plans (which have never actually existed) for a camp in Texas in 2005.
Joining Foley in threatening legislative action have been state representatives John Quinones of Florida, Jake Flake of Arizona and Bryan Hughes of Texas. Of these, Hughes of Texas actually filed legislation (House Bill 50) during a special legislative session. The Naturist Action Committee testified against that measure, and it subsequently died without leaving committee. [See NAC Advisory, July 9, 2003, and NAC Update, July 11, 2003.]
STATUS OF THE VIRGINIA BILL
House Bill 158 has been prefiled for the 2004 Virginia legislative session. The session convenes on January 14, and the bill will be officially filed on that day. At the present time, Del. Reid is the bill's only patron, but he is expected to add co-patrons by the time of the bill's introduction.
HB 158 has not yet been assigned to a committee. That assignment will be critical to the movement of the bill.
WHAT'S NAC DOING?
The Naturist Action Committee is carefully monitoring Virginia House Bill 158. NAC is also working behind the scenes to gauge legislative sentiment and support, as well as to provide information and education on the issue to key Virginia lawmakers.
WHAT SHOULD I BE DOING?
This is an Advisory. The Naturist Action Committee is not asking you to take any action at this time. In fact, NAC is requesting that you DO NOT CONTACT VIRGINIA LAWMAKERS ON THIS ISSUE AT THE PRESENT TIME. CALL TO ACTION
We need everybody to immediately phone, mail, or fax a letter to the following delegates on the General Laws Committee. It needs to be short and to the point that you oppose HB158. If you are not willing to admit being a nudist, say you are against the Commonwealth legislating family values. If you are a Republican state so, if you are from Virginia let them know that too. Please no negative comments.
An Example:
I am a registered Republican voter in the Commonwealth of Virginia, and I am writing to you to express my opposition to the captioned law proposed by Del. Jack Reid. I fail to understand how another Republican could begin to propose legislation that he knows better than parents how to raise their children and even more alarming, wants to enlist the power of the government to enforce his parental theories on the citizens of this great Commonwealth. How can Mr. Reid justify his questionable crusade to have the government of Virginia parent nudist children rather than the actual parents of those children?
Another Example:
I do not believe that the state should put itself in the position of overriding this parental consent. This seems like an attempt to legislate family values, the teaching of which should be left to parents.
Another Example:
Is this what we want the Republican lawmakers, a party of less government, to do?
The ABC/Lottery sub-committee meets at 5:00 p.m. on Thursday the 22nd of January to discuss this bill. Just three days from now. We need a family with children to appear with us in Richmond at that time, if you can do so please call Bob immediately, also anyone else who could speak in front of the committee would be greatly appreciated.

Its funny that the vote is split almost 50/50 with about 20% "ify". It would be nice to find out if that was what the general conscensus of the population is towards nudism.

URGENT CALL TO ACTION HB 158
The Alcohol Beverage Control and Gaming Subcommittee of the
Virginia General Assembly's House Committee on General Laws
has scheduled a hearing on House Bill 158, which prohibits
nudist camps for juveniles, for this Thursday, January 29.
We need as many as you as possible to show your support for
our nudist youth by attending this hearing in Richmond.
The subcommittee will meet in House Room C of the General
Assembly Building. The subcommittee hearing may start as
early as 1:00 p.m., immediately after the full committee
adjourns its meeting, also in room C.
We also need you to keep your letters and e-mails to all the
committee members coming. Committee members e-mail addresses
are at the end of this message.
We're also asking everyone to call the General Assembly
opinion line at 1-800-889-0229 to register your opposition
to House Bill 158 prohibiting nude youth camps. Your
comments will be passed on to your delegate and state
senator.
You may wish to make some of the following points, in your
own words, in your messages and phone calls. The bill
increases government involvement in family life, inherently
presumes that government knows better than parents how to
raise children, usurps parental rights to decide what's
appropriate and in the best interest of their children,
erodes family autonomy in child rearing, and lessens
parental ability to establish their own family values
House Bill 158 denies a license to any hotel, campground, or
summer camp that as any part of its activities operates a
"nudist camp for juveniles." A nudist camp for juveniles is
defined as a hotel, summer camp or campground "that is
attended by openly nude juveniles whose parents or legal

This afternoon AANR learned that VA HB158 has been scheduled for a hearing in the subcommittee on Thursday, January 29, 2004. AANR will be represented by AANR Executive Director Erich Schuttauf, and Steve Vickers, AANR staff and Nude U grad. AANR-East and NAC will also have representatives there. We will keep you posted on what is happening as soon as we know anything.

Dear AANR Members and Friends,
A public hearing for Virginia House Bill 158 was held on January 29, in the state capitol in Richmond. HB 158 is meant to prohibit licensure of any camp offering a nude youth camp for juveniles unless parents are present. Accompanying AANR Executive Director Erich Schuttauf were AANR-East President Bob Roche, AANR-East Trustee Susan Weaver, Nude U. graduate Steve Vickers, NAC Rep. Jonathan Shapiro and over a dozen members of White Tail Park.
Prior to the hearing, this dedicated volunteer team divided up into teams that met with the members and staff of the Sub-committee and the full General Laws committee. These meetings were targeted at those that will hear HB 158 on Tuesday, February 3, including the sponsor of HB 158 Chairman Reid, who is also the Chair of the General Laws Committee.
During these meeting, members of the volunteer team presented key messages in opposition to the bill. This team worked together cohesively and efficiently, and was received with courtesy and interest in most cases.
When the hearing began, these volunteers sat in an obvious block of support and togetherness. When opponents of the bill were asked to stand during the hearing, they made an impressive showing. Reid was the only speaker on behalf of his bill. AANR, NAC, and White Tail members presented an orderly, thought provoking testimony, which was recognized as such by the Subcommittee Chair, Del. Albo, who congratulated them on their effective presentation. It was evident from the interaction that there was some sympathy for our position from some delegates, but they were not willing to oppose the
determination of Chairman Reid to prohibit children from attending the camp unless a parent, grandparent, or legal guardian is present.
HB 158 was amended by Reid's suggestion to include grandparent or parent or legal guardian to be present with children attending the camp, and some compromise wording was changed as a proposed solution to a parent who leaves the camp briefly. HB 158 was reported with a "do pass" recommendation of all 4 sub-committee people in attendance.
HB 158 still continues to be problematic for our nude recreation youth camps. HB 158 will go to full committee for vote on Tuesday morning, February 3, with very limited testimony allowed.
NEXT STEPS: AANR Government Affairs and those involved are working on a game plan for the next several legislative steps, which include full Government Laws Committee, House of Delegates, and Senate action. We will keep you informed at each step. Stay tuned.
WHAT YOU CAN DO? We appreciate all of you who have written, called, e-mailed and contacted the delegates on HB 158. When our team met with delegates, there were numerous comments of how many communications had been received from our AANR members. For now, however, we are asking you to hold back your correspondences so we can carefully space and direct communications concerning this bill.

Update on Virginia HB 158
This is just a brief update about what happened in full committee when the General Laws committee heard HB 158. Thanks to Bob and his team from White Tail Park who attended that hearing today, (as well as Susan Weaver who worked on her Delagate---Delegate Hull who you'll see below proved to be significant), nudists kicked the fight against this bill to prohibit a camp for openly nude juveniles attending without their parents up a notch.
Bob offered testimony and amendments (supported by Delegate Hull who serves on the committee) to the bill which would have made clear that the bill only applies to special events and that would have allowed a parent to make written authorization for a caregiver to attend camp with their child. (You may recall that the bill currently requires a parent, grandparent, or legal guardian to be participating.) Several people on the team visiting the legislature also presented testimony against the bill.
Although Committee Chair and sponsor of the bill Jack Reid lorded over his committee enough to block the amendments and secure a favorable vote, at least four good key things happened that made the team's work well worth the effort. First, Delegate Hull abstained from the vote. This is treated as a "no" vote, which means the bill must be considered separately when it goes to the floor rather than as a mere listing on a slate of bill numbers (i.e. the consent calendar) that are just voted up. Second, several delegates tried to assist in getting the amendments offered added to the bill. This included the Vice Chair of the committee. These were adamantly opposed by Chairman Reid who, while ultimately successful in getting them stopped, was obviously flustered by this show of relatively strong opposition/defiance from his own committee. Third, as was the case last Thursday, NOT A SINGLE PERSON OR GROUP OTHER THAN CHAIRMAN REID SPOKE IN FAVOR OF HB 158. This fact was not lost on the legislators and was, indeed, pointed out to them. Fourth, following the hearing there were lawmakers who made an effort to find members of the team, including Bob, to tell (urge?) them not to abandon the fight. There are strong predictions that in the more neutral Senate the bill can be either waylaid or substantially altered.
At this time we're not asking for people to write or take action beyond those who are on the Virginia team, some of whom will be working on their House Delegates for the floor vote that HB 158 is headed towards. We're trying to recharge some batteries to hit the proper places in the Senate when the time comes. Finally, there are some legal / constitutional arguments that are being prepared as we look toward the Senate also.

The funny thing is, here in Arizona we have a youth camp as well (Hosted @ Shangri La). I have heard one senator has raised the issue just to be slaped (metaphoricly) down by the others stating there were more important things to deal with (Like the Budget!). Yay Senators in AZ.
But it is funny (and I am happy) that I havn't heard anything about it in the local papers, just in other cases (Like Texas) where it is mentioned that AZ has one aswell

keep us posted on this. i still find it troublesome.
someone might also try to distract chairman reid by making noises about opposing him in the next election for his lack of flexibility.
and the separated bill might bring the supporters out as well as a sensationalist media trying to whip up its ratings

House votes 98-1 to ban teen-only nudist camps

RICHMOND — The House of Delegates yesterday passed a bill that would make it illegal for teens to attend a nudist camp without their parents or legal guardians.
In a 98-1 vote that was punctuated by laughter, the House approved the bill and sent it forward to the Senate General Laws Committee for consideration. Delegate Charles W. Carrico Sr., Galax City Republican, was the opposing vote.
The bill, sponsored by Delegate John S. Reid, Henrico County Republican, states that the Board of Health shall not issue a license to any organization that runs a nudist camp for juveniles when parents, grandparents or legal guardians are not present.
The bill targets Camp White Tail in Ivor, in southeastern Virginia. Camp White Tail is an adult nudist camp that hosts a nudist camp for one week each summer for about 30 teens and preteens.
Bob Roche, the camp's manager, said he will fight the bill.
"We will challenge it in court if we have to," Mr. Roche told The Washington Times. "It's rather sad they are wasting the valuable taxpayer's money and time with this law."
Also fighting the bill are the American Civil Liberties Union and the American Association for Nude Recreation.
Mr. Reid said he drafted the bill when his constituents complained about Camp White Tail's special nudist camp in June for children ages 11 to 17.
Florida is the only other state that has nudist camps for juveniles.
