Bra-vo! $29G in topless suit

A woman who was busted for walking around topless has won a $29,000 civil rights settlement from the city, her attorney said yesterday.
Jill Coccaro, 27, an East Village artist also known as Phoenix Feeley, was arrested two years ago when she went for a shirtless stroll on a hot night on Delancey St. on the lower East Side.
But unbeknownst to the cops who charged her with indecent exposure, Coccaro has the right - affirmed by a 1992 state appeals court ruling - to bare her pierced pair anywhere in New York, her lawyer Jeffrey Rothman said.
"It was a civil rights settlement," he said. "We hope the police learn a lesson and respect the rights of women to go topless."
Rothman said that in addition to the bogus arrest, cops yanked his client by her hair and rendered her nearly bottomless when they ripped her pants during the collar.
A week after her Aug. 4, 2005, arrest, Coccaro was joined by about a dozen women bearing nearly all at a protest of her arrest.
"We have to affirm a women's right to be top-free," Coccaro told the Daily News.

What is amazing to me about that story is that the cops apparently weren't abreast of the law making it legal for women to go topless in New York. I live all the way across the country in Southern California and even I knew that.
I think they made boobs of themselves over that bust.

Yes doc interesting name alright. As far as I know the women involved in this were strippers. Point is though that they got the law upheld and the cops will be less quick off the mark in future in other situations.

It looks like the police had nothing to hold up thier case. If they made her wear a bra, would it be entrapment?

I was joking about it, but this is actually a topic I take quite seriously. I can't help but think that the arresting cops knew of the law, but wanted to test it. Whatever the girl's motive was for going topless in public, her win is good for all of us.
I have been ticketed for "indecent exposure" for being topless at a textile beach. The section of beach I was on was virtually empty, so I know that no one could have called in a complaint. I felt wronged by the incident, and apparantly I was, for the ticket was never filed at the courthouse. The cop must have changed his mind.
My whole issue with topfreedom for women is less about "fairness" and more about reclaiming my body from the dictates and definitions of a hypocritical and lascivious culture. To define a woman's breasts as sexual objects which must be concealed, and then create an entire industry around tantilizingly packaging them (Vitoria's Secret, et. al) or using them to sell everything from beer to cheeseburgers (As in those disgusting Carl's Jr. commercials) is a form of victimization in my opinion.
What if I don't wish to present my breasts as sex objects; am I given a choice? Yes, wear a baggy flannel shirt and cover them up. What if my breasts aren't perky and perfect, or artificially pumped up with implants; does that mean I am less sexy as a woman? If I choose not to wear a bra under my snug tanktop, why do I get angry stares from other women who can't seem to keep their eyes off my chest? That bothers me more than anything else.
Even though I know I can't change the way that our society has chosen to value me and profit off my body, I remain stubborn and a bit defiant. I hope my fellow nudies will understand.

Well said Annie. I have seen men with bigger breasts tan some women. They don't have to cover up. The whole thing is so stupid. The only part of the breasts that must be covered are the nipples. With some bikini tops that is all that is covered. I wonder if a women wore pasties in public if she would be considered topless.

I believe pasties are legal most places as are penis socks for men. The problem is worrying they won't stay on and the jiggle factor. BTW the point of the post is women do NOT need to cover their nipples in NY.
